Terms of sale.

These terms explain who sells the products, how orders are formed, and the rights and responsibilities that apply to purchases through eclipsemio.com.

1. Seller and scope

The seller is Vladyslav Lishafai, trading as Eclipse Mio, NIE Z4073946F, at Plaza Victoria 17, 4B, 29012 Málaga, Spain. Email: info@eclipsemio.com. Telephone: +34 641 524 648.

These terms apply to standard online orders placed through this website. Separately quoted, customized, or wholesale B2B orders may include additional written terms. Mandatory consumer rights always prevail over any conflicting term.

2. Products and safe use

The main product characteristics, pack quantity, price, stock information, and certification claims are shown before checkout. Images are intended to represent the product accurately, but minor colour or packaging variations may occur without changing its essential characteristics.

Solar-viewing glasses must be used only in accordance with the instructions supplied with the product. Inspect them before every use. Do not use a pair that is scratched, punctured, torn, creased across a filter, detached, or otherwise damaged. Children require direct adult supervision. Product information on the website does not replace the supplied safety instructions.

3. Prices, tax, and payment

Prices are in euros and include Spanish IVA where applicable. The applicable delivery charge, including any free-shipping threshold, is shown before the customer continues to Stripe checkout. No delivery charge is added after the total has been presented.

Payment is processed on a Stripe-hosted checkout. Eclipse Mio does not receive or store full card details. A payment may be refused or reviewed by Stripe or the card issuer under their security and fraud-prevention controls.

If a clear pricing or availability error affects an order, we will contact you promptly. We will not charge a corrected higher price without your express agreement; if the order cannot be fulfilled at the confirmed price, the amount paid will be refunded.

4. Placing an order and contract formation

  1. Select a pack and delivery destination, review the item price, delivery charge, and total, then choose Secure checkout.
  2. Enter and verify the requested delivery and payment information on Stripe.
  3. The contract is concluded when Stripe confirms successful payment and the order confirmation is displayed or sent, subject to any mandatory right to cancel.

Please save the confirmation and these terms. If we cannot accept or fulfil a paid order because of stock, address, safety, or suspected-fraud issues, we will contact you and refund the affected payment without undue delay.

5. Delivery and transfer of risk

Available destinations, current charges, packaging methods, and delivery rules are set out in the Shipping & Delivery Policy. Unless a different period is expressly agreed, goods will be delivered without undue delay and no later than 30 days after the contract is concluded.

Where we appoint the carrier, risk of loss or damage remains with us until you, or a third party you designate other than the carrier, takes physical possession. Ownership passes upon full payment and delivery.

6. Withdrawal, returns, and refunds

EU consumers generally have 14 calendar days after receiving the goods to withdraw without giving a reason. The procedure, return-cost allocation, refund timing, exceptions, and model form are in the Returns & Refunds Policy.

Standard stock packs are not treated as personalized merely because a quantity was selected. Goods made to a customer’s specifications or clearly personalized may fall within a statutory exception.

7. Legal conformity guarantee

For consumer sales governed by Spanish law, we are responsible for lack of conformity that existed on delivery and becomes apparent within three years after delivery. Statutory remedies are free of charge and may include repair or replacement where appropriate, price reduction, or termination of the contract under the conditions established by law.

Contact us with the order number, a description, and useful photographs. These practical details help us respond and do not reduce statutory rights.

8. Business and custom orders

A person ordering predominantly for business purposes is not treated as a consumer where the law says otherwise. Custom printing, bespoke packaging, reserved production, or high-volume B2B orders may require a written quotation, deposit, lead time, and cancellation terms. No B2B term removes rights that legally apply to a purchaser acting as a consumer.

9. Liability

Nothing in these terms excludes or limits liability or consumer remedies that cannot lawfully be excluded. Subject to that rule, neither party is responsible for losses that were not reasonably foreseeable when the contract was made or, for business customers, for indirect commercial losses unless separately agreed.

The customer is responsible for following the supplied safety instructions and for stopping use if the product becomes damaged. This does not exclude responsibility for a defective or non-conforming product.

10. Privacy and communications

Personal data is handled as described in the Privacy Policy. Transactional messages about payment, delivery, safety, support, or a legal request are part of administering the order and are not marketing messages.

11. Complaints, law, and jurisdiction

Please send complaints to info@eclipsemio.com, identifying the order and requested solution. We will try to respond promptly and in good faith.

Spanish law governs the contract, without depriving consumers of mandatory protections available under the law of their habitual residence. Consumer disputes may be brought before the courts determined by mandatory consumer and procedural law; no clause here requires a consumer to litigate exclusively in Málaga.

12. Changes and severability

The terms presented when an order is placed govern that order. Later updates apply only to later orders unless a legal change must apply. If one provision is invalid, the remaining provisions continue to apply to the extent permitted by law.
